CFTC has sent the crypto rules to the White House, but don’t mistake that for regulation taking effect.
On September 17, CFTC submitted RIN 3038-AF80 to the White House OIRA for review. The title is Regulation of Crypto Asset Trading and Crypto Asset Markets.
The stage is listed as Prerule, and the text has not yet been released. This comes two days after CLARITY failed to pass the Senate by 49 to 50.
Simply put: Congress couldn’t get legislation through, so regulators are taking the slow administrative rulemaking route.
