U.S. Department of Justice intervenes in xAI's challenge to Colorado's AI discrimination law

AIMPACT update: On April 25 (UTC+8), the U.S. Department of Justice announced that it has recently stepped in in xAI’s lawsuit challenging Colorado’s “algorithmic discrimination” law. In 2024, Colorado passed a law that regulates the use of AI algorithms, explicitly prohibiting the use of discriminatory AI systems in areas such as employment and housing. xAI, founded by Elon Musk, has challenged the law, arguing that it places excessive limits on AI technology innovation. The DOJ’s intervention escalates this legal battle: if xAI prevails, it could weaken states’ authority to regulate AI; if it loses, it could serve as a legislative reference for other states. The DOJ’s move shows that the federal government is taking a proactive approach to AI regulation, and the outcome of this lawsuit could have a significant impact on the direction of AI regulatory policies across the United States.
