Mong Kok rape case in Hong Kong withdrawn: Two Mainland men released without self-incrimination concerns, one approved for legal fee reimbursement

ME News message: On April 19 (UTC+8), there has been progress in a rape case in Hong Kong. Two mainland men are accused of sexually assaulting a drunken woman at a hotel in Mong Kok in November 2025. During the period when the case was originally scheduled to be heard, the suspects remained in custody. The prosecution recently applied to withdraw the charges at the West Kowloon Magistrates’ Court, and the application was approved. One of the defendants’ applications for legal fees was approved.

The magistrate held that although the two admitted to having had sexual relations with the complainant, this did not constitute “self-incrimination,” and the magistrate did not agree with the prosecution’s opposition. The prosecution stated that, after further investigation and seeking legal advice, it decided to withdraw the charges, and both defendants have been released.
