The CFTC has submitted a proposal on prediction market event contracts to the White House Office of Management and Budget for review, a move that signals an intensification of the struggle between federal and state officials over how to regulate this rapidly growing sector. The proposal is expected to be based on the CFTC’s consultation held in the spring, which attracted more than 3,000 public comments covering insider trading, banned contracts, market safeguards, and the legal structure of event contracts. If this rule is approved, it would provide the United States with the first comprehensive federal prediction market contract framework. This could affect how platforms such as Kalshi and Polymarket serve U.S. users, especially as the industry faces increasing legal pressure from state regulators.
