The Markup Drama How the Vote Was Saved
The hearing was nearly two and a half hours of contentious debate. Senator Elizabeth Warren declared the bill "is just not ready," while Senator Chris Van Hollen introduced an amendment to bar senior government officiall including the president and vice president from having business ties to the crypto industry. That amendment failed 11–13 after Senator Bernie Moreno argued it fell under the Judiciary Committee's jurisdiction, not Banking.

The turning point came when Chairman Scott made a last-moment maneuver: he agreed to admit further amendments he had previously rejected, winning last-minute Democratic support from Warner and Gallego. Senator Lummis secured a flurry of bipartisan votes on her amendments, strengthening consumer protection provisions. The ethics provision amendment was the most contentious it failed, and the ethics fight remains the biggest unresolved issue as the bill moves forward.

Immediate Market Impact
BTC spiked to $82,000 on the news before retreating to $81,500, up 2.5% through the day. Coinbase stock led crypto equities higher. The broader market also benefited from the upbeat Cerebras IPO debut, which lifted both crypto and traditional tech stocks. S&P 500 and Nasdaq closed at record highs that same day.

However, the rally faded quickly. By May 17, BTC had slipped back to $78,182 as selling pressure resumed. The taker buy/sell ratio sits at 0.87, and 11 consecutive red 4-hour candles were recorded the next day. The initial euphoria was real, but the structural selling had not disappeared.

What Comes Next — The Road Ahead
The bill now faces four critical hurdles before becoming law:

Full Senate floor vote: Requires 60 votes to pass. The 15–9 committee margin is encouraging, but the full Senate includes more skeptical voices. The ethics fight over crypto-related conflicts of interest for government officials could become a dealbreaker.
Merge with Senate Agriculture Committee version: The Agriculture Committee has its own version covering commodity-related provisions. Reconciling these two versions could take weeks.
House reconciliation: The House has already advanced separate crypto legislation. The two chambers must agree on a unified bill.
Presidential signature: President Trump previously stated he would not sign any legislation until the SAVE America Act a voting reform bill clears Congress in its strongest form.
The July 4 target for final passage remains ambitious but is being discussed as a realistic timeline by market watchers. The next 30 days will determine whether the ethics fight derails the bill or whether bipartisan momentum carries it through.

Why This Matters Beyond the U.S.
Clear U.S. regulation sets the template for global crypto governance. Every major jurisdiction from the EU with MiCA to Japan and South Korea is watching. If the CLARITY Act becomes law, it creates a model for splitting SEC/CFTC-style oversight that other countries can adapt. For traders, investors, and builders, this means reduced enforcement uncertainty, better institutional access, and a more mature market infrastructure. The bill is not perfect the ethics provisions need work, the banking lobby still has concerns, and labor unions warn about financial stability risks.
