Senate Releases CLARITY Draft That Would Exempt Bitcoin and Ethereum From SEC Securities Law

Senate Banking Republicans released draft text of the CLARITY Act with a January 1, 2026 ETF cutoff and a 60-day SEC auto-certification window ahead of Thursday’s committee markup. The draft would sharply limit how the SEC can classify Bitcoin, Ethereum, and some other digital assets as securities. The bill still needs Democratic support to pass the full Senate.
