AIMPACT News, on May 1st (UTC+8), Elon Musk testified in the OpenAI lawsuit that during the training of the xAI Grok chatbot, some OpenAI models were used, and this “distillation” technique is an industry practice. Musk co-founded OpenAI in 2015 with Altman, Brockman, and others as a non-profit organization, left in 2018, and is currently suing OpenAI for deviating from its original mission. Distillation refers to querying existing models via API and using their outputs to train new systems, which can significantly reduce costs. xAI was launched in July 2023, entering the competition with Google and Microsoft. Musk’s testimony indicates that the distillation method is not only used by Chinese AI developers accused by Anthropic but also adopted by American companies. The legal boundaries of this method are unclear and may involve violations of platform rules or API usage terms.
