On August 5, 2026, Shaw Walters, founder of Eliza Labs, declared the ElizaOS token "completely" dead and confirmed the foundation is winding down after settling a class-action lawsuit filed by Burwick Law in U.S. District Court for the Southern District of New York. The remaining treasury was handed to plaintiffs as part of the settlement.

The token, which launched on October 24, 2024, as AI16Z on Solana, peaked at approximately $2.47 per token on January 2, 2025, reaching a market capitalization of about $2.6 billion. As of August 5, the successor ELIZAOS token traded near $0.00031 with a market capitalization of roughly $2.3 million. Burwick Law filed the case on April 20, 2026, alleging false advertising, deceptive practices, and misrepresentation that the project was autonomously governed when insiders retained actual control. Walters stated the foundation will no longer support the token, with no buybacks or price mechanisms planned, though the open-source ElizaOS AI agent framework will continue development independently.
