The boundaries of authority between the SEC and CFTC have long been a major point of debate in the regulation of crypto assets in the US. The bill aimed to clarify the position of assets considered digital commodities under the CFTC and define the SEC's jurisdiction over assets deemed securities.
For investors, the meaning is simple: The more uncertain a crypto asset's legal status is, the greater the uncertainty over which rules apply to that asset.
🤔Why is this important for Bitcoin, Ethereum, and altcoins?
The CLARITY Act is not a law that directly determines the price of any crypto asset. However, clarifying the regulatory framework could affect the rules under which exchanges, custodians, financial institutions, and other market participants operate.
Therefore, the main issue investors need to follow is not only whether the law passes, but also what kind of regulatory model the US will create for the digital asset market.
The issue of legal classification is particularly important in the altcoin market. Whether an asset is classified as a commodity, security, or another category can have consequences in various areas, from exchanges' listing policies to institutional access.
Why were 60 votes so important?
The vote on September 15 was not the final vote on whether the CLARITY Act would ultimately become law. It was the procedural threshold required for the Senate to advance the bill and open it for debate.
However, the fact that the bill received 49 votes at this stage, which required 60 votes, showed that political consensus had not yet been reached on the current text.
Therefore, the key conclusion for investors is that regulatory uncertainty in the US will continue, at least in the short term.
The stablecoin and DeFi sides are also important
The CLARITY discussions did not focus only on major assets such as Bitcoin and Ethereum.
The latest drafts also addressed issues such as the conditions under which DeFi protocols would need to register with the CFTC, obligations under the Bank Secrecy Act, and the impact of stablecoins on the traditional banking system.
Therefore, the future of the law is important not only for the classification of tokens, but also for the overall functioning of the crypto sector.
What should be monitored next from a market perspective?
With the CLARITY Act unable to advance in the Senate, investors need to focus particularly on the following:
✅️A new bill text or an attempt at a compromise
The failed vote in the Senate does not mean that the regulatory debate has ended. However, a new compromise must be reached on a new text.
✅️How the SEC and CFTC use their existing powers
Until a comprehensive market structure law is passed, the existing regulatory framework and the agencies' practices will remain important.
✅️Stablecoin regulations
Because of the steps the US Congress has previously taken regarding stablecoins, this area will continue to be one of the crypto market's key regulatory issues independently of CLARITY.
✅️The approach of institutional investors
Reduced regulatory uncertainty could be an important factor in traditional financial institutions' decisions to enter the digital asset market. Therefore, the responses of banks, brokerages, and asset managers to regulatory developments in the US can be closely monitored.
