The court in Minnesota stopped a law that would have made it a crime to use prediction markets. A judge named Katherine Menendez made this decision a few days before the law was supposed to start on August 1. This law was going to make it a felony to operate prediction markets in Minnesota which means people could have gone to prison for up to five years and had to pay a fine of $10,000.

The state of Minnesota tried to impose this law because Governor Tim Walz signed it on May 18. This law was very broad. Would have affected any platform that offered event-based contracts to people living in Minnesota. These platforms would have been in trouble if they did not stop offering these contracts.

Some companies, including Kalshi and Polymarket and the Commodity Futures Trading Commission did not agree with this law. They went to court. Said that the contracts they offer are actually "swaps" and should be controlled by federal law, not state law. This means that the state of Minnesota does not have the power to make these contracts a crime.

Judge Menendez agreed with these companies. Said that they are likely to win the case. She decided that the law in Minnesota probably goes against law and granted a preliminary injunction. This means that the law cannot be enforced until the court makes a decision.

This decision is important not for Minnesota but for other states too. If the court ultimately decides that federal law controls these contracts then other states will not be able to make them a crime. The prediction market industry sees this case as a test of whether they can be controlled by law or if they will be subject to different laws in each state.

For now the law in Minnesota that would have made prediction markets a crime is on hold. The courts decision shows that they think federal law should control these contracts. This case is not yet but for now people who use prediction markets in Minnesota do not have to worry about being charged with a crime.
