The US ITC issues a final ruling on Section 337 for semiconductors manufactured abroad and their downstream products and components

Deep Tide TechFlow news: On July 16, according to Sina Finance, the U.S. International Trade Commission (ITC) voted to initiate a Section 337 investigation (investigation code: 337-TA-1511) into certain dynamic random access memory (DRAM) devices and their downstream products and components (II) (Certain Dynamic Random Access Memory (DRAM) Devices, Products Containing the Same, and Components Thereof (II)). The complainant alleges that the export to the U.S., import into the U.S., and sale within the U.S. of the relevant products violate U.S. Section 337 (infringed U.S. registered patents: 12,646,537 and 12,650,937), and requests that the U.S. ITC issue a limited exclusion order and a cease-and-desist order.

Named defendants include: Samsung Electronics Co., Ltd., Suwon, Republic of Korea; Samsung Electronics America, Inc., Plano, Texas; Samsung Semiconductor, Inc., Plano, Texas; Google LLC, Mountain View, California; Super Micro Computer, Inc., San Jose, California; NVIDIA Corp., Santa Clara, California; and Broadcom Inc., Palo Alto, California.

The U.S. International Trade Commission will determine the target date for the end of the investigation within 45 days after filing. Except in cases where the U.S. Trade Representative disapproves the relief measures for policy reasons, the remedial orders issued by the U.S. International Trade Commission in Section 337 cases take effect on the date of issuance and have final effect starting on the 60th day after the date of issuance.
