New York judge pauses a lawsuit over ownership of 39,000 Bitcoin wallets; an amicus hearing is scheduled for July

Mars Finance News, according to a report by The Block, New York State Supreme Court Judge Kathy J. King signed an order to pause a lawsuit seeking to claim ownership of 39,069 dormant Bitcoin wallets. A hearing is scheduled for July 14 on a key amicus brief. The plaintiffs in the case are using the pseudonym “Noah Doe” and two shell companies, and they are seeking to claim these wallets under New York State’s Unclaimed Property Law. Attorney Ian R. Cohen filed an amicus brief opposing the plaintiffs’ claims. He argued that the Unclaimed Property Law is intended for tangible items, whereas blockchain addresses are always visible to the entire world; if the original owners are unable to extract assets due to security vulnerabilities, that is a passive loss of access rather than a voluntary abandonment. Cohen emphasized that the plaintiffs do not have the private keys, and that the blockchain network “structurally disregards” judicial rulings; the court’s declaration cannot truly transfer ownership of the assets and may instead be used by the plaintiffs to mislead exchanges and custodians. Previously, on May 26, it was reported that an American man and two companies filed a lawsuit seeking ownership of more than 39,000 dormant Bitcoin address.
