Crypto journalist Eleanor Terrett revealed that the bipartisan small-scale negotiations surrounding the CLARITY Act ended that evening without reaching an agreement.


Republican lead negotiator and Senator Cynthia Lummis stated that all parties had reached 99% consensus on the bill and hoped that Democratic colleagues would continue to resolve the remaining 1% of disagreements after the bill passes through committee, otherwise if similar incidents like FTX happen again in the future, all parties will find it hard to avoid blame.
Democrats raised concerns in the final stages about provisions related to the Blockchain Regulatory Certainty Act (BRCA), which aims to prevent non-custodial software developers from being prosecuted under laws governing currency transmission.
Terrett said that substantive progress was made in negotiations over ethical issues, but the final disagreement over amendments to the BRCA prevented the agreement from being finalized.
