Legal Litigation Period: U.S. Court of Appeals Temporarily Restores Trump's 10% Global Tariffs

A U.S. federal appellate court temporarily halted the lower court’s ruling against the Trump administration’s 10% global tariffs on Tuesday, allowing these tariffs to remain in effect while the government appeals.

This decision means that the three importers who just received a tariff suspension last week must continue paying the tariffs.

The U.S. Trade Court previously ruled that the 10% global new tariffs imposed by President Trump under Section 122 of the Trade Act were illegal, but did not broadly prohibit the collection of tariffs. The Department of Justice argued that immediately canceling the tariffs would disrupt trade negotiations and trigger a wave of refund lawsuits.
