CFTC and SEC Strengthen Collaboration on Predictive Market Regulation Boundaries

On May 10, FOX reporter Charles Gasparino revealed that the U.S. CFTC and SEC have aligned their positions on the regulatory boundaries concerning predictive markets and recent unusual trading related to the Iran conflict. Gasparino noted that while the public perceives this area to be solely under CFTC jurisdiction, the SEC will intervene significantly when predictive contracts can legally be defined as ‘securities.’ He also disclosed that, in addition to previously announced cases, regulatory agencies may initiate more enforcement actions targeting predictive markets in the future.
