OFAC warns that paying fees through the Strait of Hormuz to Iran risks sanctions

The U.S. Department of the Treasury warns that the “passage fee” recently demanded by Iran to ensure safety when passing through the Strait of Hormuz may violate U.S. sanctions.

OFAC states that the payment methods mentioned include fiat currency, digital assets, offset transactions, in-kind payments, and donations to certain organizations or accounts of Iran. The agency notes that these payments may be related to sanctions imposed on Iran and the Islamic Revolutionary Guard Corps (IRGC).

OFAC also reminds that U.S. persons and foreign entities controlled by the U.S. are generally prohibited from transacting with the Iranian government, IRGC, and Iranian digital asset exchanges. Non-U.S. entities involved in related payments or supporting Iranian financial organizations may also face secondary sanctions, or civil and criminal liabilities.

The agency recommends that shipping companies and maritime service providers increase due diligence for vessels passing through Iranian waters or calling at Iranian ports. It is currently unclear if any specific cases have been prosecuted related to this warning.
