AI agents bypass platform rules, Guangzhou Internet Court holds first trial for an AI-related unfair competition case
Mars Finance News, May 1 — The Guangzhou Internet Court recently held a public hearing on a case of online unfair competition involving AI intelligent agents. This case was designated as a model trial for new types of unfair competition disputes involving AI intelligent agents at the court.
A certain technology company and a system company jointly sued, accusing the defendant, a certain technology limited company, of developing and open-sourcing an AI chatbot without obtaining permission from either plaintiff. The software uses the underlying “Accessibility Service” permissions of the mobile operating system to automate actions such as clicking and sending messages, effectively bypassing the technical management measures of the plaintiff’s platform and disrupting normal platform operations.
The defendant’s official website also published a “version disguise” tutorial and false appeal guidance to help users evade platform risk controls. The plaintiff is claiming 100k yuan in damages.
The defendant claims that the software is a free, open-source, non-profit project, with automation performed by independent third-party components, and role scripts uploaded by users themselves. The platform has integrated content review services and has fulfilled its reasonable obligations.
Before the hearing, the court issued a preservation order—requiring the defendant to immediately stop providing the software download, delete the evasion tutorials, delete the user data already obtained, and disconnect links containing role scripts that undermine AI security risk control mechanisms. The defendant has fully complied.
