Musk argued in court that he only responded after OpenAI posted publicly first, and the judge then suggested “let’s start fresh from today,” which Musk, Altman, and Brockman agreed to. The trial officially entered the opening statements phase, with the jury set to review years of emails, text messages, and company documents among OpenAI founders to determine whether the leadership betrayed founding principles when shifting toward profit and accepting Microsoft’s investment. Expected witnesses include Microsoft CEO Nadella, former OpenAI executives Mira Murati and Ilya Sutskever, as well as the mother of Musk’s several children and former OpenAI director Shivon Zilis.
