Elon Musk's lawsuit against OpenAI goes to court on Monday, with both sides exchanging barbs before the hearing.
According to Beating Monitoring, the Musk vs. OpenAI case officially opened in the Federal Court of Oakland, California, on April 27th local time, with jury selection taking place that day, and opening statements expected to begin on Tuesday. On the day of jury selection, both sides engaged in intense exchanges on X.
OpenAI’s official account first fired, claiming “We can’t wait to present our evidence in court; the truth and the law are on our side. This lawsuit has been an unfounded, jealous attempt at competitive suppression. We finally have the opportunity to have Musk testify under oath in front of a California jury.”
Musk then responded with continuous counterattacks, claiming Altman and Brockman “stole a charity,” nicknaming Altman “Scam Altman,” stating Brockman received stocks worth hundreds of billions of dollars, and that Altman profited through dozens of OpenAI-related transactions. He also claimed Altman did not disclose his ownership of the OpenAI Startup Fund to the board, lied under oath in Congress about not profiting from OpenAI, and reposted a video clip of former OpenAI director Helen Toner calling Altman a “liar.” Musk said, “It could have been established as a profit-making company, but I chose to create, fund, and recruit for a public interest organization, and then they stole this charity.”
Case core: Musk accuses Altman and Brockman of promising to keep OpenAI non-profit forever when founding it in 2015, inducing them to invest $38 million, but OpenAI later transitioned to a profit-oriented structure. Musk claims damages up to $134 billion, with all compensation to be returned to the non-profit part of OpenAI, and requests the removal of Altman and Brockman, as well as the reversal of the profit-making transition. The presiding judge is Yvonne Gonzalez Rogers, with the liability phase expected to last until mid-May, and both sides will testify.
