Supreme Court decides Enbridge and Fluor

The Supreme Court recently decided two cases, Enbridge Energy, LP v. Nessel and Hencely v. Fluor Corp. In Enbridge, the Court unanimously ruled that equitable tolling does not apply to the 30-day limit for removing cases from state to federal court. In Fluor, a 6-3 decision rejected a broad “battlefield preemption” doctrine that had barred an injured servicemember’s claims against a private defense contractor, remanding the case for further proceedings and reaffirming judicial federalism and congressional prerogative.
