Verizon Avoids $175 Million Verdict Due to Patent Owner’s Delay
Verizon Communications Inc. successfully evaded a $175 million patent infringement verdict because a federal judge ruled that the patent owner, Headwater Research LLC, had unduly delayed filing its lawsuit. Headwater knew of the alleged infringement by early 2017 but waited until July 2023 to sue, which allowed it to maximize potential damages over the six-year statutory period. This delay led to an implied waiver of Headwater’s right to bring the suit, effectively erasing Verizon’s liability.
