I just saw a rather concerning analysis about how the Clarification Act could end up replicating the same mistakes we saw with MiCA. A crypto lawyer who closely follows these issues, Yuriy Brisov, has raised an important red flag.
The interesting thing is that MiCA already showed how not to do things when it comes to regulating DeFi. The European framework was criticized for not truly understanding how decentralized finance works, and worse, it ended up stifling innovation instead of creating a space for it to grow.
Now, if the Clarification Act makes the same regulatory mistakes without learning from what happened in Europe, we could be seeing a dangerous pattern. A cryptocurrency law expert like Brisov is pointing out that if this isn’t carefully designed, DeFi projects could end up paralyzed by regulations that don’t understand them.
The concern is legitimate. If regulators don’t consult those who truly understand how the ecosystem works, we’ll end up with rules that kill innovation instead of protecting users. It’s a reminder that crypto regulation needs people who understand the space, not just old templates applied to new technology.
