Santiago Court orders the return of funds stolen from checking account

The Santiago Court of Appeals has ordered Banco Santander Chile SA to restitute funds fraudulently stolen from a client’s current account. The court found the bank’s refusal to return the funds arbitrary, citing Law N°20.009 which mandates restitution in cases of fraud, especially since a prejudicial measure by the bank to suspend the restitution was rejected. This ruling emphasizes the bank’s obligation to provisionally return defrauded amounts under the law, even while further investigations into potential user negligence may proceed.
