Odaily Planet Daily reports that Coin Center released a report stating that crypto software code constitutes “functional speech” and should be protected under the First Amendment of the U.S. Constitution. The organization believes that writing and publishing code is similar to writing books or publishing recipes, with developers being “expressers and inventors,” rather than asset custodians or intermediaries.
The report points out that merely publishing and maintaining software should be strictly protected, but when developers directly control user assets, execute transactions on behalf of users, or make decisions for users, they may fall into the scope of regulation.
This statement comes at a time of increasing regulatory controversy. Coin Center emphasizes that developers should not be regarded as financial intermediaries solely for enforcement convenience, and calls for continuing existing free speech principles in the context of new technologies, rather than expanding the boundaries of criminal liability.
