Hey, a question many of us ask ourselves: what happens if we don't go to work on February 14th? Can they fire us for that? Well, here is the truth according to Mexican law. First, it's important to understand what the day of love and friendship means under labor law: basically nothing. It is not an official holiday, so technically your boss can ask you to attend as usual. If you don't go without permission, your absence is considered unjustified and will be deducted from your salary. Now, it’s not that you get fired for a single absence. The Federal Labor Law states that justified dismissal occurs when you accumulate more than 3 absences within 30 days, and these absences must be unjustified. A single absence on February 14th, isolated, is not grounds for termination. But here’s the catch: if you already have a couple of absences that month, adding this one could push you over the limit. The smartest move is to talk to your boss beforehand, ask for a vacation day or negotiate a shift change. That way, you avoid a deduction from your paycheck and enjoy the day stress-free.
