Federal Court Blocks Trump's EV Charger Funding Freeze: Judges Restore $5B Infrastructure Allocation
A federal judge in Seattle has delivered a decisive blow to the Trump administration's efforts to halt a major clean energy investment program. U.S. District Judge Tana Lin ruled that the Department of Transportation illegally froze $5 billion allocated for EV charger installation across the country. The funds were originally authorized by Congress through the Infrastructure Investment and Jobs Act in 2021 and represent a critical component of America's national EV charger network development strategy.
What Prompted the Legal Showdown
When Transportation Secretary Sean Duffy assumed office in early February, the DOT and Federal Highway Administration abruptly terminated access to the NEVI Formula Program funds without following established administrative procedures. This action triggered an immediate legal challenge from twenty Democratic-led states and Washington D.C., who argued that the suspension violated congressional intent and administrative law. Judge Lin's analysis supported this argument, concluding that the government "yanked the NEVI Formula Program's cord out of the outlet" in direct contradiction to the legal framework governing these funds.
The Court's Permanent Solution
Rather than issue a temporary restraining order, Judge Lin established a permanent injunction preventing the Transportation Department from recalling funds or canceling previously approved projects. This means states including California, Colorado, and Washington can now proceed with their planned EV charger infrastructure initiatives using congressionally appropriated dollars. Environmental advocates, including organizations like the Sierra Club, welcomed the decision as essential protection for clean energy investment. Washington Attorney General Nick Brown's office called it "a resounding win for the rule of law and for smart investment in our clean energy future."
Political Battles Continue Despite Legal Setback
While the court victory appears decisive, the underlying policy conflict remains unresolved in Congress. The Senate is expected to consider legislation that would redirect $879 million originally designated for EV charger programs toward traditional infrastructure projects. This measure has already passed the House. If Senate approval follows, portions of the EV charger funding could potentially be reallocated despite the judicial ruling. The Trump administration continues pursuing broader policy shifts, including eliminating EV tax incentives and supporting automakers focused on conventional combustion engines rather than electric alternatives.
The court's decision establishes that the executive branch cannot unilaterally eliminate congressionally funded EV charger programs through administrative action, but it does not prevent Congress itself from modifying appropriations or shifting policy direction through legislation.
