#CLARITYActCouldBeDelayedUntil2028

While everyone in the market is debating the fate of a new legislative bill, the real story is unfolding not in the corridors of Congress, but within the rulebooks quietly being drafted by regulatory agencies—and in the legal footing that stablecoins are beginning to secure.

Following the midterm elections, the Democrats' takeover of both chambers of Congress has cast doubt on the future of the CLARITY Act—the legislative framework most eagerly awaited by the crypto world. Analysts and industry representatives suggest the bill could be shelved until 2028. Yet, this delay does not mean the ecosystem has come to a standstill; rather, the nature of the resistance is shifting.

Why has the legislative process stalled?

The CLARITY Act actually began as a success story, passing the House of Representatives in July 2025 with a vote of 294 to 134. Its objective was to clarify when a token should be classified as a security versus a commodity. However, the bill hit a wall in the Senate. A vote held on September 15, 2026—which required 60 votes to move forward—failed, with 49 in favor and 50 against.

Two primary points of contention fueled this failure: demands for ethical rules to prevent public officials from profiting from crypto investments, and concerns that the yields offered by stablecoins could draw deposits away from traditional banks. Now, with the Democrats in control of the Senate, several vocal critics of the legislation are assuming leadership roles in key committees—making the prospect of the bill’s revival virtually zero.

Why hasn't the market collapsed?

When the election results were finalized, there was no panic selling in the crypto market. The primary reason for this is that prediction markets had already priced in this outcome weeks in advance. Although Bitcoin hit a seven-week low of $75,618 on election night, it recovered rapidly, returning to the $78,000 range.

This does not mean the market is entirely at ease. Short-term uncertainty led to the liquidation of leveraged positions; approximately $288 million worth of long positions were liquidated within a 24-hour window on election night. This suggests that investors remain hesitant to take on large positions in the absence of legal clarity.

Where is progress being made despite the lack of a clear legislative framework?

Even though the CLARITY Act has been shelved, certain sectors of the industry continue to advance through their own specific legislative efforts. A prime example is the GENIUS Act—a stablecoin bill that garnered bipartisan support—which establishes a federal framework for payment stablecoins and mandates that issuers maintain liquid reserves. This helps insulate such stablecoins from political volatility.

The situation is similar regarding tokenized securities. Industry representatives note that regulatory bodies continue to develop frameworks for tokenized assets by leveraging their existing authority. Major institutions, such as the Depository Trust & Clearing Corporation (DTCC), are actively building the infrastructure necessary to offer tokenized equities in international markets. In other words, the migration of Wall Street onto the blockchain is progressing along its own trajectory, independent of specific legislative bills.

Does uncertainty signify a new kind of order?

While the deferral of the CLARITY Act until 2028 might appear to be a setback for the crypto market, it actually signals the onset of a period in which regulatory bodies will likely take a more active role. For investors, the absence of specific legislation does not mean an absence of rules; rather, the pronouncements of regulatory bodies and the outcomes of legal proceedings will shape the market's new direction.

In this climate of uncertainty, stablecoins and tokenized assets stand out as the fastest-evolving sectors, largely because their operational frameworks are already well-defined.

In the short term, the uncertainty surrounding the CLARITY Act may continue to drive volatility in leveraged trading. In the medium term, however, the focus will shift from legislation to the rules established by regulatory institutions.

Key factors to watch include the stated positions of those who will lead Senate committees, the ongoing debate regarding the impact of a stablecoin framework on bank deposits, and the pace at which infrastructure for tokenized equities gains traction. Even if legislation is delayed, adoption can still progress through alternative channels.
