Why is everyone looking at Congress as the ballots are being counted?
As of November 4, the vote count is underway in the United States. Early results suggest that control of Congress could shift in favor of the Democrats. This change could influence the direction of a wide range of areas—from cryptocurrency regulations to prediction markets—extending well beyond Washington.
In Virginia, Democratic Senator Mark Warner has secured reelection. Nationwide exit polls place President Trump’s approval rating at 38%—a figure even lower than the level seen in 2006, when the Democrats won both chambers of Congress. Contests are taking place for all 435 seats in the House of Representatives and 35 of the 100 seats in the Senate. Currently, the Republicans hold a 53–47 majority in the Senate and a 219–214 majority in the House.
Three scenarios are on the table; which one appears most likely?
Leading up to the election, three potential outcomes were discussed.
The first is a divided Congress: the Democrats take the House, while the Republicans retain the Senate. The Democratic leader in the House has indicated that the party is on the verge of regaining the majority. In this scenario, legislation might pass the House but stall in the Senate.
The second is a "blue wave"—a scenario in which the Democrats win both chambers. Prior to the election, prediction markets and analyses estimated a greater than 90% probability for a Democratic win in the House and over 60% for the Senate. The third scenario is the status quo: the Republicans maintaining control. Former President Trump had previously stated that he would be prepared to exercise his veto power should the Democrats win.
Why did the anticipated legislation for crypto stall?
The CLARITY Act—a bill the industry had been awaiting for months—failed to advance in the Senate this September; it fell short of the 60-vote threshold, with a tally of 49 to 50. The bill was intended to clarify which entity would serve as the primary regulator for digital assets.
Most analysts believe that if the Democrats secure a majority in Congress, it is unlikely that this legislation will be revisited in 2027. However, some argue that the election outcome alone will not fundamentally alter the overall trajectory of the digital asset markets. In other words, the door is not closing—but the key is changing hands.
Why are prediction markets affected by this election?
Prediction markets, which have recently gained support at the federal level, may now face a new debate regarding their oversight. A Democratic victory could lead to discussions about a more stringent regulatory framework.
This scenario could favor established, traditional exchanges. Essentially, there is a possibility that legacy players—those operating under older, more conventional rules—could regain prominence within the space pioneered by innovative platforms. As is often the case, regulation dictates the direction of the game.
How did the markets react on election day?
In the week leading up to the election, there was a sell-off in technology stocks, with the Nasdaq falling by 2.9% and the S&P 500 by 1.8%. On election day, however, a recovery among major tech companies pushed the indices back upward. Amidst this uncertainty, Bitcoin fluctuated near the $77,000 mark, rising 1.1% on election day to reach $77,533, while Ethereum traded at $2,292, up 1.6%. Gold, meanwhile, remained subdued below $4,000; the uncertainty surrounding the election did little to move it.
History offers an interesting perspective. Looking at the 20 midterm elections held since 1946, the S&P 500 has delivered an average return of 7.5% in the three months following an election, compared to 1.8% in the three months leading up to it. Since 1950, the index has seen an average 12-month gain of 14.6%. Whether history will repeat itself remains to be seen, but markets generally favor the resolution of uncertainty.
This election is not just about who wins; it is about which legislative topics will take center stage over the next two years. Cryptocurrency regulations, the future of prediction markets, and the broader legislative agenda will all be shaped by the composition of Congress.
Although initial results suggest a shift in favor of the Democrats, the vote count is still underway, and each district is telling its own story. It is best not to draw major conclusions until the results are finalized. The legislative calendar, regulatory announcements, and how the market behaves once the uncertainty has cleared are the key signals you should watch.
