SEC Moves Without a Stage: New Crypto Regulations Approved Through Separate Votes


The US SEC has finally moved forward with its “Regulation Crypto Assets” proposal, but the way it was approved has become the most interesting part of the story.
After the open meeting scheduled for August 14, 2026, was suddenly canceled, the SEC commissioners then approved the issuance of the proposal through a “seriatim vote” mechanism, with each commissioner voting separately outside an open meeting.
However, what matters more is not only how the SEC voted, but also what it ultimately managed to push forward.
The proposal creates a special framework for certain investment contracts involving crypto assets. The SEC has proposed two registration exemption pathways: up to US$5 million over four years for certain structures, and up to US$75 million every 12 months for another pathway. The proposal also includes a safe harbor concept after an issuer completes or permanently stops the important managerial efforts previously promised in the investment contract.
A Different Perspective: Washington Is Not Waiting for Congress
This development comes as discussions over the CLARITY Act continue to face obstacles in Congress.
This is where the true significance of the SEC’s move lies: the regulator is beginning to act using the authority available to it, even as major legislation remains unfinished. Reuters reported that legislative stagnation has pushed agencies such as the SEC and CFTC to take a larger role in shaping crypto policy through regulations and regulatory actions.
The market’s message today is not that US crypto regulation is complete. Quite the opposite: a new era is beginning, in which regulators are starting to build bridges while Congress continues debating the permanent foundation.
However, investors need to understand one important point: this is still a proposal, not a final rule. The proposal will enter a 60-day public comment period and may still change before the SEC takes final action.
In conclusion, this SEC move could be a positive signal for the US crypto sector, especially for projects that need a clearer capital-raising pathway. But the real victory will come only if the regulator’s temporary certainty is ultimately supported by a long-term legal framework.
The SEC has finally moved. Now the market is waiting: is this merely a proposal, or the beginning of new rules for the digital asset economy?
