According to a notice on the Ministry of Commerce website, a spokesperson of the Ministry of Commerce answered questions from reporters regarding the U.S. publication of the final measures of the “forced labor” 301 investigation.
Question: On July 23, U.S. Eastern Time, the Office of the U.S. Trade Representative issued final measures based on the results of the “forced labor products not prohibited for import” 301 investigation, imposing 301 tariffs on 60 economies including China, including a 12.5% 301 tariff increase on China. What is the response from the Chinese side?
Answer: We have noted the relevant situation. The Chinese side has consistently opposed forced labor, established a sound system of labor laws and regulations, and firmly safeguards against and cracks down on forced labor practices. By contrast, the U.S. side not only has yet to approve joining the “Forced Labor Convention, 1930,” but has also long manipulated the issue of “forced labor.” This time, it also launched a 301 investigation and imposed unilateral tariffs on the grounds of “forced labor,” which is a typical act of unilateralism and protectionism. The Chinese side firmly opposes it.
We have also noted that the U.S. side has repeatedly said it intends to replace the tariffs under the International Emergency Economic Powers Act (IEEPA), which has been ruled ineffective, and the 122 import surcharge, with 301 tariffs. In the course of China-U.S. economic and trade consultations, the U.S. side has clearly committed that the additional tariffs to be imposed on Chinese goods as a substitute will not exceed 20%. Currently, the additional tariffs to be imposed by the U.S. on Chinese goods as a substitute are 12.5%. The Chinese side’s countermeasures against the first round of the so-called fentanyl tariffs by the U.S. and against its reciprocal tariffs remain effective. We will continue to closely monitor and conduct comprehensive assessments of the U.S. side’s subsequent moves, and we retain the right to take all necessary measures.
The Chinese side urges the U.S. side to correct its erroneous practices and completely cancel the relevant unilateral tariff measures. The Chinese side is willing to continue dialogue and consultations with the U.S. side on the basis of mutual respect and equality and mutual benefit to address each side’s concerns. We hope the U.S. side will take actions in step with China, jointly uphold and implement the consensus reached in economic and trade consultations, continuously reduce the list of problems, extend the list of cooperation, and make greater contributions to building a constructive and stable strategic relationship between China and the U.S.
