On February 6, 2026, the People's Bank of China and seven other departments jointly issued the "Notice on Further Preventing and Disposing of Risks Related to Virtual Currencies and Other Matters" (Yinfa [2026] No. 42), which clarifies that virtual currencies are not legally tender, and related activities are illegal financial activities. All exchange, trading, intermediary, RWA tokenization, and marketing activities within the country are fully prohibited.‌‌

The new regulations do not prohibit individuals from holding virtual currencies, but ban trading, exchange, promotion, and service provision; law enforcement will focus on cracking down on platforms, fund channels, marketing, and cross-border capital flows.‌

Currently, there are no "legal cryptocurrency trading channels," and all domestic exchanges and OTC matching platforms lack regulatory licenses. Participating in overseas platform trading may still face risks such as fund freezing, account seizure, or even legal accountability.
