Latest update on the lawsuit between OpenAI and Musk: Sam Altman will testify in court today

Deep Tide TechFlow News, May 12 — According to CNBC, the case of Elon Musk suing OpenAI is ongoing in the U.S. District Court in Oakland, California. OpenAI Board Chairman Bret Taylor continued testifying on Tuesday local time, followed by CEO Sam Altman taking the stand. Taylor stated that during Altman’s brief removal in 2023, the company’s situation was “extremely critical,” and claimed that under the current corporate structure, the non-profit entity still holds control, with investors like SoftBank and Thrive Capital making the new structure a condition for their investments. Microsoft CEO Satya Nadella also testified on Monday, defending Microsoft’s over $13 billion investment, and stated that Musk has never contacted Microsoft regarding compliance issues related to the investment.

Additionally, House Oversight Committee Chairman James Comer has sent a letter to Altman, requesting clarification by May 22 on potential conflicts of interest involving Brockman holding shares in Altman’s fund and OpenAI’s planned investment in Helion, a nuclear fusion company in which Altman has personal stakes. Musk alleges in the lawsuit that Altman and others violated OpenAI’s founding promise of being a non-profit and used approximately $38 million in donations for unauthorized commercial purposes.
