In the case involving artist Huang Ziqiao and the creative private room incident, the criminal group used the Telegram (, also known as the messaging platform, as a medium for criminal activities. However, the latest privacy policy of Telegram clearly states that if a judicial authority submits a valid order confirming that a user is a suspect in a criminal case involving a violation of Telegram's terms of service, Telegram may provide relevant information regarding the individuals involved.

Telegram's latest privacy policy: will provide data to law enforcement agencies

According to Telegram's official latest privacy policy section 3.3.1: "Telegram is a cloud service. We store your messages, photos, videos, and files from your cloud chats on our servers, allowing you to access your data from any device at any time without relying on third-party backups. All data is strongly encrypted, and each encryption key is stored in multiple data centers across different jurisdictions. This way, local engineers or physical intruders cannot access user data."

and Article 8.3: "If Telegram receives a valid order from the relevant judicial authority confirming that you are a suspect in a criminal case involving a violation of Telegram's Terms of Service, we will conduct a legal analysis of the request and may disclose your IP address and phone number to the relevant authorities. If any information is shared, we will record such instances in the transparency report published each quarter."

This means that if law enforcement agencies request user data from Telegram through legal processes, Telegram will provide the user data. It is important to note that Article 8.3 refers to "criminal cases," meaning that data will only be provided in the context of suspected criminal activity.

During the creative private event, Telegram was used as a medium for spreading underage pornography information. Zhang Xiuyuan, Director of the Protection Department of the Ministry of Health and Welfare, has stated that Telegram could be completely blocked in two situations.

Telegram has been notified but the chat room has not been removed within 24 hours.

Unable to connect to the Telegram platform.

The secret chat feature allows only both parties to see the messages.

However, it is worth noting the Privacy Policy section 3.3 Your Messages, 3.3.1 is Cloud Chat, and 3.3.2 is Secret Chat: Secret Chat uses end-to-end encryption. This means that all data is encrypted with a key known only to you and the recipient. Neither we nor anyone else can know the content transmitted in these messages, except for direct access to your device.

We will not store your secret chat on the server, nor will we keep any logs of secret chat messages, so after a short period, we no longer know who you communicated with or when through secret chat. For the same reason, secret chat cannot be used in the cloud. You can only access these messages from the device that sent or received the messages.

Therefore, under the premise of using the secret chat feature, due to the privacy protection mechanism, even Telegram itself cannot know the messages in secret chats. It should be reiterated that the tool itself is neutral. Telegram was also widely used during the anti-extradition protests in Hong Kong.
