Indonesia will submit a “suspension of concessions” request to the World Trade Organization dispute settlement mechanism against the European Union, citing the EU’s failure to comply with a WTO ruling in a palm oil litigation case. Indonesian Trade Minister Budi stated on the 7th that the EU did not adjust its policies on time or fully comply with the rulings and recommendations of the palm oil dispute resolution mechanism, therefore Indonesia has decided to submit a “suspension of concessions” request to the WTO. He indicated that the suspension mainly focuses on goods trade, but the Indonesian government does not rule out requesting suspension of concessions in other areas. The WTO “suspension of concessions” is an authorized retaliatory measure, which allows the injured party, when a member fails to implement WTO dispute resolution rulings, to suspend obligations such as tariff concessions against the offending party under WTO authorization, usually manifested as unilateral retaliatory tariffs, aiming to compel the offending party to comply with multilateral rules.
