Tech Sina News, Beijing time, March 26, CNBC reports that Elon Musk’s legal team is requesting that Judge Kathaleen McCormick of the Delaware Court of Chancery recuse herself from two Tesla lawsuits because she liked a LinkedIn post criticizing Musk, showing bias.

In a recusal motion filed on Wednesday, Musk’s lawyers wrote: “Given the court’s recent public support for the LinkedIn post, which has created an impression of bias against Musk in these cases, recusal is necessary and appropriate. These cases should be reassigned to another judge randomly drawn from this court.”

Musk’s lawyer states that McCormick used a heart reaction on a post supporting her, rather than a simple ‘Like’. The post praised a ruling by the San Francisco federal court that could cost Musk over $2 billion. In that case, a jury found Musk had committed fraud against Twitter investors on the eve of his acquisition of Twitter.

McCormick wrote to Musk’s lawyer that she had not read the full LinkedIn post in question, did not support it, and did not intend to click any supportive emoji, possibly just accidentally touched the icon. She also stated in the letter that she had reported “suspicious activity” on her LinkedIn account.

Alex Spiro, partner at Quyn Eagle Law Firm and Musk’s attorney, told CNBC in an email that he had inquired with LinkedIn about the matter and stated, “I see no basis for the ‘system malfunction’ explanation.”
