Judge Richard Eaton of the International Trade Court in Manhattan stated that delays in processing some refund applications are causing an "increasingly unfair phenomenon" between large importers and small businesses.
Eaton pointed out that this unfairness is an "unintentional consequence" of the government's design of the $166 billion illegal tariff refund system, and he said he does not believe the government is deliberately favoring large importers.
However, he noted that the Trump administration's appeal of the March 4th ruling requiring the government to refund all tariffs is delaying the refund process.
