But that night, seven Democratic senators collectively voted it down, and Polymarket’s passage odds fell further to 37%. On the surface: it bans the President, Vice President, members of Congress, and their spouses from issuing or sponsoring digital assets. This is the “red line” Democrats have been pushing for months, and it seems to have been written into the bill. In reality, it’s just Trump toying with Democrats: 1. In-term provision: state attorneys general and private parties have no power to enforce—only the DOJ can. The problem is—that the Attorney General himself has publicly said in Congress, “I am Trump’s lawyer.” Let Trump’s lawyer enforce Trump’s moral clause—only Trump could pull off something like that. 2. The sunset clause is precisely timed to become ineffective the moment Trump’s term ends—then the next DOJ would have no authority to pursue any illegal conduct during Trump’s term.
