I just found out that many people don’t know how overtime pay works in Mexico, and honestly, it’s information that everyone should be clear about. According to Profedet, there are three different ways to calculate it, and the difference can be quite significant in your paycheck.



Basically, the first 9 hours of overtime work per week are paid at double the regular rate. If you earn 50 pesos per hour, those extra hours are paid at 100 pesos. But if you work beyond those 9 hours, here’s the good part: they are paid at triple, so 150 pesos per hour in the same example. There’s also a third case, when there is risk involved in the company and they need to extend the workday to prevent harm, the same criteria apply.

The interesting part is that you have up to one year to claim this payment. If your boss or HR doesn’t give it to you voluntarily, you can go to Profedet’s offices with your ID, pay stubs, and the company’s address. Bring all the documentation you have regarding how overtime is calculated and paid in your specific case.

Additionally, a labor reform is coming that proposes 40-hour workweeks starting in 2030, gradually reducing two hours per year from 2027. The interesting thing is that overtime in this new structure will be voluntary and will continue to be paid at double or triple, depending on whether it’s part of the regular workday. So, the issue of how overtime is paid will remain relevant even with the upcoming changes.
