People’s Finance and News (People’s Financial Information), April 2—On April 2, the Supreme People’s Procuratorate released six typical cases of procuratorial organs serving the development of new productive forces. These cases cover key core technology areas such as semiconductor manufacturing, 3D intelligent mapping software, and biological research reagents, among others. Some of the cases involve technologies that China is “bottlenecked” by, demonstrating the procuratorial organs’ firm stance and professional capabilities in lawfully safeguarding scientific and technological innovation. It is reported that the typical cases released this time include 3 cases of crimes of infringing trade secrets, 1 case of crimes of stealing, spying, bribing, or illegally providing trade secrets for the benefit of overseas parties, 1 case of crimes of copyright infringement, and 1 case of crimes of counterfeiting registered trademarks. These cases not only fully reflect the quality and efficiency of the intellectual property procuratorate in performing duties and handling cases, but also actively respond to the judicial protection needs of high-tech enterprises’ intellectual property. Meanwhile, they strengthen public legal education efforts, which helps actively create a strong social atmosphere in which people respect knowledge and value innovation. A person in charge of the Supreme People’s Procuratorate’s Intellectual Property Prosecution Division said that this set of typical cases fully demonstrates the procuratorial organs’ functional role in serving the development of new productive forces tailored to local conditions. By comprehensively performing functions such as reviewing arrests, reviewing prosecutions, conducting supplemental investigations, and issuing procuratorial recommendations, procuratorial organs handle every case with high quality and efficiency. For example, in a case of Zhang X and others involving the infringement of trade secrets handled by procuratorial organs in Shanghai, the conduct concerned core technical secrets in China’s chip design sector. The procuratorate leveraged the strength of technical experts to accurately identify the core characteristics of the technical information, providing professional support for case handling. It focused on the substantive review of technical evidence such as appraisal opinions—by strictly examining appraisal procedures and qualifications, appraisal methods and grounds—to ensure that technical evidence can prove the core facts of the case. It issued procuratorial recommendations to relevant enterprises to help them close loopholes and build sound systems.
