Court Rejected xAI's Claims Against OpenAI in Elon Musk's Company Case

Although the plaintiff pointed to the departure of eight specialists who nearly simultaneously moved to a competing organization, the court noted the absence of documents proving that OpenAI representatives actively facilitated or coordinated these transfers.

The judge emphasized that individual incidents, such as keeping work correspondence on personal devices and refusing to provide confidentiality agreements, alone cannot serve as grounds to accuse the company as a whole. Such actions, according to the court, more likely indicate behavior of individual employees rather than a coordinated company strategy.

xAI Allegations: Code and Internal Information Leaks

During the proceedings, xAI claimed that two of the eight departing employees may have obtained the company’s source code. Additionally, the plaintiff alleged attempts to access internal databases after the specialists joined OpenAI. However, court documents did not contain direct evidence linking these alleged incidents to deliberate actions by the company itself.

xAI reserves the right to file an amended lawsuit with more specific claims and expanded evidence. At the time of the ruling, xAI representatives did not provide an official comment regarding the court’s decision.
