However, the nomination process has hit a significant roadblock. His blockade will remain in place until a controversial criminal investigation into current Fed Chair Jerome Powell is completely closed .

The investigation at the heart of this standoff was launched by U.S. Attorney Jeanine Pirro, an ally of President Trump. The probe focuses on whether Chair Powell misled Congress during his June 2025 testimony regarding $2.5 billion in cost overruns related to the Federal Reserve headquarters' renovation project .

Critics, including Senator Tillis and a federal judge, view this investigation as a pretext to harass Powell for not lowering interest rates quickly enough to match President Trump's demands . Powell himself has stated that the probe stems from the Fed's refusal to cut rates as dramatically as the President wanted .

3. ⚖️ The Judicial Intervention

The situation took a dramatic turn on March 13, 2026, when Chief U.S. District Judge James Boasberg intervened. He blocked the criminal probe and quashed the grand jury subpoenas issued against Powell .

In his ruling, Judge Boasberg was highly critical of the investigation, stating there is a "mountain of evidence" that the probe's purpose was to harass Powell. He famously wrote that the government had "produced essentially zero evidence to suspect Chair Powell of a crime" and that the investigation was merely a pretext to force him to either cut rates or resign .

4. ⚖️ The Appeal and Continued Stalemate

Despite the judge's ruling, U.S. Attorney Jeanine Pirro has vowed to appeal the decision, vowing to continue the fight . This decision to appeal is the direct reason the nomination remains stalled.

Because the investigation is technically still alive due to the appeal, Senator Tillis has reiterated his position. He stated that appealing the ruling "will only delay the confirmation of Kevin Warsh as the next Fed Chair" . Tillis celebrated the judge's ruling as confirmation that the investigation was a "failed attack on Fed independence" and urged the U.S. Attorney's office to move on to avoid further delays .

5. 🔵 Bipartisan Opposition

While Senator Tillis's hold is the most immediate hurdle, Warsh's nomination also faces unified opposition from Democrats on the Banking Committee. In February, all 11 Democratic members, led by Ranking Member Elizabeth Warren, sent a letter to Committee Chairman Tim Scott demanding a delay in any nomination proceedings .

They argue that the "ongoing efforts by the President to control the Fed—which must be able to exercise independent judgment—undermine public confidence in any nomination for chair at this time" . They refuse to participate in what they call a "farcical effort" while the administration pursues what they term "sham" investigations against Powell and Governor Lisa Cook .

The timeline for Warsh's confirmation is now entirely uncertain and depends on the legal battle.

· If Pirro drops the appeal: The investigation would be closed, satisfying Senator Tillis's condition and potentially allowing the nomination to move forward.
· If the appeal proceeds: The nomination could remain frozen for weeks or months. If Warsh is not confirmed by the time Powell's term ends on May 15, Powell would still remain on the Fed Board as a governor and would likely continue to lead rate-setting meetings, creating an ironic twist where the administration's own actions delay its goal of replacing him .
