Kroger hit with 2 lawsuits over e-commerce role classification
Kroger is facing two class-action lawsuits for allegedly misclassifying its e-commerce manager position as exempt from overtime pay. The lawsuits, filed in Colorado and Washington, claim that e-commerce managers’ primary duties involve order fulfillment, which are non-exempt tasks, and that they regularly worked over 40 hours without overtime compensation. The plaintiffs seek to recover unpaid overtime wages and other damages, claiming at least 100 individuals in each state could be eligible to join the suits.
