The U.S. Department of Justice applies to extend the suspension period of the ineffective judgment on tariffs against China or may appeal to the Supreme Court.

The U.S. Department of Justice on Monday asked the U.S. Court of Appeals for the Federal Circuit to extend a stay on a tariff invalidity judgment previously handed down by a lower court on May 28. The administration said the ruling undermined the president’s ability to carry out foreign policy. The Federal Circuit Court can now rule at any time whether to suspend the order in the appeal process, which can last for months. The U.S. government has also said it will resort to the U.S. Supreme Court if the appellate court lifts the current suspension.
