Details of the nation's first AI model infringement case revealed
Caijing News reported on April 23. At a press briefing held this morning (the 23rd) by the People’s Court of Chaoyang District, Beijing, the case details of the country’s first AI model infringement case—the “Transforming Comic Effects” case—were officially disclosed. The case is also the first in the country to clearly protect the structure and parameters of artificial intelligence models.
After trial, the court held that the similarity in the imaging effects of the two special effects meant that the “Girl Comic Effects” constituted a substantial substitute for the “Transforming Comic Effects.” The defendant’s conduct caused substantial damage to the plaintiff’s competitive interests, thereby constituting unfair competition. The court therefore ruled that the defendant compensate the plaintiff for a total of 1.6 million yuan in economic losses and reasonable expenses. The court of second instance upheld the original judgment.
The court pointed out that the ruling in this case makes clear that the parameters and structure of an artificial intelligence model formed through methods such as data training and optimization and fine-tuning can provide operators with innovative advantages and business returns, and that such competitive interests are protected under the Anti-Unfair Competition Law. This is of great significance for the future protection of artificial intelligence models and the handling of similar cases. (CCTV News)
