A Beginner’s Guide to New U.S. Crypto Tax Rules

Tax Certification Forms (W-9 / W-8 Forms)

To comply with U.S. tax regulations, Gate US is required to collect a tax certification form from all users. Depending on your tax status, you will be asked to complete:

  • Form W-9 — for U.S. taxpayers
  • Form W-8 — for non-U.S. taxpayers

These forms help determine your tax classification and allow Gate US to meet required reporting obligations with the IRS.
Starting January 1, 2027, if the correct form is not submitted, backup withholding may apply to certain taxable transactions, such as cryptocurrency sales or exchanges. Your transactions may be subject to backup withholding at a current rate of 24% on all proceeds.

For users registering on or after January 1, 2026, Gate US will require the appropriate tax form to be completed within one month of registration. If the form is not submitted, withdrawal restrictions may apply until verification is completed.

IRS Reporting Requirements

Under updated U.S. tax regulations, cryptocurrency exchanges and brokers—including Gate US—must report certain transaction information to the IRS.

Gate US will be required to report:

Form 1099-DA (New IRS Form)

Used to report gross proceeds from your cryptocurrency sales or exchanges.

Gross proceeds refer to the total amount you receive from a sale or exchange, before subtracting fees or cost basis.

Cost Basis Reporting

Gate US will also report cost basis information when available.
Cost basis reflects the original value of the cryptocurrency,including eligible transaction fees, and is used to determine taxable gains or losses.

As a taxpayer, you may need to report activity on your individual tax return using:

Form 1099-DA — reports sales/exchanges of digital assets
Form 1099-MISC — reports miscellaneous income of $600 or more, such as certain rewards

Gate US will make these documents available for download beginning January 2026.
